Section 7216 consents, signed and on record
When a tax preparer uses or discloses a client's tax return information for purposes other than preparing the return, the client's written consent is generally required under IRC ยง7216, except where the regulations allow otherwise. For individual (Form 1040 series) return information, the consent must follow the format in Rev. Proc. 2013-14.
How SignLucid helps
- Upload your own 7216 consent. SignLucid places the signature and date fields, and each signer is guided to them.
- Send it on its own, or together with your engagement letter.
- The signed PDF ends with a certificate of completion: consent to e-sign, signing time, IP address, device and the full event history.
Questions
- Do you provide the consent wording? No. The wording and when a consent is needed are your firm's decision; check Rev. Proc. 2013-14 and ask your attorney.
- Can a 7216 consent be signed electronically? Yes. Rev. Proc. 2013-14 lets a client sign a Section 7216 consent electronically by typing their own name (or a PIN you gave them). When an envelope includes a 7216 consent, SignLucid asks the signer to type their full name themselves โ it is never pre-filled โ and records that on the certificate. Keep the consent as its own document, and give the client a copy (they can download it right after signing).
