Quick answer
Are e-signatures legally binding?
Short answer: in the U.S., most business documents can be signed electronically with the same effect as ink; tax forms filed with the IRS follow IRS rules (see guides 1 and 5).
- The federal ESIGN Act and state UETA laws say a signature can't be denied effect just because it's electronic.
- Broadly: the signer consents to electronic records, shows intent to sign, the signature is tied to the record, and the record can be kept and reproduced.
- A few documents, such as wills, can't be e-signed; ask your attorney if unsure.
- IRS forms have their own rules (see guides 1 and 5).
